1. INTRODUCTION

1.1) The conference is organized and managed by Tech Faktory Ventures Pvt. Ltd, a company that is registered in India and registered office is at Sector 18, Gurgaon, India.

1.2) Any references to “us” means Tech Faktory Ventures Pvt. Ltd and references to “our” and “we” shall be interpreted accordingly. Reference to “Participant” and “you” means the entity accomplishing a booking or ticket request and references to “your” shall also be interpreted accordingly. By completing the booking request the entity accepts and becomes bound with the present provisions of Terms and Conditions with Tech Faktory Ventures Pvt. Ltd.

1.3) All request to register for the conference, and all orders to purchase the relevant ticket or documentation pack, are made subject to these Terms & Conditions (which shall apply to the exclusion of any terms imposed by you).

1.4) You acknowledge and accept that we have the right to publicly announce our business relationship with you which shall include but not be limited to announcements on social media. Such announcements shall not be deprecating or otherwise unfavorable to your business.

1.5) Conference is the event in the realm of Blockchain will be held in Asia, Middle East, Europe, America (hereinafter – “Conference” or “Event”)

2. BOOKINGS

2.1) All applications to register or book a seat for the conference are subject to availability and you making full payment.

2.2) We will let you know the booking status by sending you an email within 3 days of our receipt of your booking request. Booking status will either be confirmed or rejected.

2.3) Delegate passes issued for any particular conference are valid for named attendee only and cannot be transferred which is also subject to clause 4.2 below.

2.4) Cost of replacing lost or damaged delegates’ passes is $50.

2.5) You can request to make amendments to your booking requests not later than 2 days before the event by writing an e-mail to info@block-hedge.com

3. PRICES AND PAYMENT

3.1) Participation at the conference is not allowed without a payment in advance for the registration fee.

3.2) Our prices for attending the conference, and for purchasing the documentation pack for the conference, are set out on the relevant registration booking form or the relevant purchase order form or can otherwise be obtained from us upon request or from our website. Prices may be subject to change from time to time All the prices are stated without GST and other applicable taxes.

3.3) The registration fee includes only the participation to the Conference and the Conference documents that will be provided to you. Lunches and beverages are not included unless otherwise mentioned.

3.4) You must bear your own travel and accommodation expenses and make arrangements on your own. We do not take any responsibility for the reservation of accommodation.

3.5) You are also requested to arrange for travel and health insurance. The registration fee does not automatically include insurance.

3.6) If your booking has been confirmed an invoice will be sent to you via email within ten (10) working days setting out the relevant payment instructions and terms. Payment should be made immediately upon receipt of this invoice.

4. CHANGES TO THE CONFERENCE AND CANCELLATIONS

4.1) It may be necessary for unavoidable circumstances to change the location and/or timing, and alter the advertised content or advertised speakers. We reserve the right to change this at any time without prior notice. However, if we make any significant changes at the last moment, we will notify you the same. In addition, we also request to keep yourself updated by visiting our social media channels and website.

4.2) By any reasons if you are unable to participate the conference, we will welcome substitute delegate (s) wish to attend in your place at no extra cost. To be able to get this facility, you should notify us by email at least 2 days in advance. Please notify us of any substitutions at: info@block-hedge.com.

4.3) If you are unable to attend the conference or make the cancellation, you would not be entitled to get a refund whether full or partial.

4.4) We shall not be liable to you for travel, accommodation or other costs and expenses incurred (included wasted costs and expenses) including the case we are required to cancel or relocate the conference as a result of an event outside our control (including, without limitation, to acts of God, lightning, fire floods, storm, military operations, explosion, war, acts of terrorism or threats of any such acts, lock-outs, any strike action or other industrial action and a pandemic, epidemic or other widespread illness).

5. CONTENT

5.1) All rights in all documentation, presentations, audio-visual recording and including material published or otherwise made available as part of the conference are owned by us or are included with the permission of the owner of the rights.

No (i) professional photography, recording or filming or (ii) republication, broadcast or other dissemination of the Content is permitted. You shall not distribute, store, transfer, reproduce or modify in any other way or use any of the Copyrighted Content, and in particular (but without limitation) you or your delegates shall not:

5.1.1 Upload and save any Copyrighted Content into any shared system, database or website.

5.1.2 Transmit, re-circulate or otherwise make available any Copyrighted Content to anyone else;

5.1.3 Make any commercial use of the Content whatsoever; or

5.1.4 Use Content in any way that might infringe third party rights or that may bring us or any of our affiliates into disrepute.

5.2) The Content does not necessarily reflect our views or opinions.

5.3) Advice or suggestions contained in the content should not be relied upon as a professional or other advice. We hereby exclude to the fullest extent permitted by law all liabilities, claims, costs, losses, damages, and/or expenses arising from any omission or inaccuracy in the content arising from any defamatory, infringing or otherwise unlawful information or material in the content.

5.4) We reserve the right to remove or suspend access to such content made available online at any time without prior notice.

6. LIABILITY

6.1) Subject to Clause 6.4, our aggregate liability to you, whether such liability arises in contract, tort (including negligence) or otherwise, for any damages, loss, costs, claims or expenses of any kind howsoever arising, out of in connection with any booking (or requested booking) made by you or otherwise in relation to a conference, shall be limited to the price paid by you in respect of your booking to attend the event.

6.2) Subject to Clause 6.4, we shall not be liable to you for (i) any loss of profit, loss of or damage to data, loss of anticipated savings or interest, loss of or damage to reputation or goodwill or; (ii) any indirect, special or consequential damages, loss, costs, claims or expenses of any kind.

6.3) You agree to indemnify us, our staff and our affiliates and to hold us harmless to the fullest extent permitted by law, against all loss, claims, expenses, costs or of any kind arising from any act or omission by you (including your delegates) during or otherwise in relation to a conference.

6.4) Nothing in this these Terms and Conditions shall limit or exclude either party’s liability for:

6.4.1 Accident, personal injury or death caused by that party’s negligence, or the carelessness of that party’s employees, subcontractors or agents.

6.4.2 Fraud or fraudulent misrepresentation; or

6.4.3 Any other liability which cannot be limited or excluded by applicable law.

7. ANTI-BRIBERY POLICY

7.1) You warrant that you shall:

7.1.1 Comply with all relevant laws, regulations, and statutes relating to anti-bribery and anti-corruption

7.1.2 Promptly report to us any request or demand for any undue influence.

7.2) Any Breach of the clause 7 shall be considered a significant breach of these Terms and Conditions.

8. GENERAL TERMS AND CONDITIONS

8.1) These Terms and Conditions contain the entire agreement and understanding between us and supersede all prior agreements, understandings or arrangements (both oral and written) relating to the subject matter of these Terms and Conditions and any such document. However, we may include any document herein with to pursuant to these Terms and Conditions.

8.2) You acknowledge here that in registering a delegate or representative place you have not relied on, and shall have no remedy in respect of, any statement, warranty, representation, promise, understanding, or assurance (whether innocently or negligently made) of any person other than as expressly set out in these Terms and Conditions.

8.3) You should accept that any communication with us will mostly be electronic. We may contact you by e-mail or provide you with information by posting notices on our website.

8.4) You will not be able to re-sell, transfer, assign or otherwise dispose of any of your rights or obligations arising under these Terms and Conditions.

8.5) These Terms and Conditions and the rights and obligations of both parties shall be governed by, and construed in accordance with, the laws of India and both parties irrevocably agree to submit to the exclusive jurisdiction of the courts of India in respect of any dispute which arises hereunder.

9. PRIVACY POLICY

9.1) Upon registration for the Conference, your personal details such as full name, company, country and email address etc. will be collected to prepare a list for the benefit of all Participants. These details may also be available to parties directly related to the event. We may collect, use and store these data for the purposes related to these terms and conditions.

9.2) We may use these data for future correspondence via email.

9.3) During the Conference anyone can photograph and/or film you. And we may use those photographs and videos bearing your image for posting on this and/or other websites.

9.4) By registering in the conference, you give us your consent to the processing of your personal data, including photographs and/or videos bearing your image, by us in accordance with applicable data protection laws strictly for the above-mentioned purposes.

9.5) By submitting the registration you hereby give the consent for us to store the following types of data as a profile for internal purposes:

A) Mandatory & voluntary data are collected when making a booking for the Conference.

B) Voluntary disclosures when participating in online surveys.

C) If opted to receive email communication about our forthcoming events, you give us consent for us to use the data for advertising purpose.

D) Data is also collected from any social media for which you have provided to us.

E) You give your consent for us to collect and store data relating to you personally from public domain sources and use the same for the purpose of targeted advertising communications to you.

F) We have free lifetime use of any image or video content created by attendees at the Conference.

10. PROPRIETARY RIGHTS

10.1) All material and content made available related to the event are protected by property rights. Except as expressly authorized by us, participants may not sell, rent, modify, license, distribute, reproduce, transmit, copy, edit, or create derivative works from such materials or content.

11. OBLIGATORY RIGHTS

Cancellation of the Conference

11.1) We cannot be held liable if the conference is postponed or canceled due to unavoidable circumstances. Under these circumstances, we will reimburse full/part of the registration fee after deducting costs already incurred by the organization, in the form of credit note which can be availed in any of our other conferences.

Modification of the Conference programme

11.2) We reserve the full right to modify the conference agenda.

Disclaimer

11.3) As regards to the conference, our liability shall be limited to its gross negligence. In any situation/case, we will not be liable for any damages, costs such as transportation costs, financial losses, accommodation costs, any loss of business, or profits, opportunity, data, goodwill, use, whether arising directly or indirectly or any incidental, special or consequential damages.

11.4) Presenters alone are responsible for the content of their respective presentations and/or handout and only for presentation purposes only. The views and opinions expressed in the presentations/handouts are not endorsed by us. We disclaim any legal liability for their content given in the presentations or materials distributed as a part of the conference or presentation.

Participation in the Conference

11.5) You are expected to behave professionally. You are liable for the damages caused to others or the venue’s property.

11.6) By sending the booking request to the Conference you confirm that you possess the full capacity and you are a person of majority age under personal applicable laws.

12. VOLUNTEERS

12.1) By agreeing to act as a volunteer at an event, you acknowledge that:

a) You will not receive any compensation for travel, accommodation etc.

b) We do not guarantee that you will be appointed to be a volunteer at the conference.

c) It is strictly prohibited to violate rules of the event including drug usage and the ban on alcohol during the Conference;

d) You confirm that all the information supplied to us by you is actual and valid;

e) Selection as a volunteer automatically grants us the permission to use the volunteer name, voice, words, and likeness in social media, television, film radio, magazines, newspapers and other media, both during and anytime after the event, and in any form, for communicating and advertising for the purpose of the Conference;

f) In the course of the conference, sometimes you may be dealing with sensitive or confidential information and you agree to keep that information as strict as possible;

g) You have read carefully and understood these terms and conditions fully and all other related documents.

13. OTHER LEGAL PROVISIONS

13.1) Should individual provisions of these general terms and conditions be invalid, this shall have no effect on the validity of the remaining provisions.

13.2) These general terms and conditions shall be governed in all respects by the laws of India, excluding its conflicts of law’s provisions. In case of a dispute arising out of or in connection with these general terms and conditions, the courts of India shall have exclusive jurisdiction to settle any dispute which may arise under or in connection with these general terms and conditions.

13.3) You hereby agree that we may send you the requests for participating in our online surveys and accept that the data received by us from the surveys’ results can be used for commercial purposes.

13.4) We are authorized to change any of these Terms and Conditions from time to time. Your continued use of the website of the Conference following such change shall be subject to and including the changes made to the terms from time to time.

13.5) You agree not to copy, modify or use these Terms and Conditions for any illegal purposes.

13.6) You agree to be fully responsible for (and fully indemnify us against) all claims, liability, damages, losses, costs and expenses, including legal fees, suffered by us and arising out of any breach of the terms by you or any other liabilities incurred by us arising out of performance of your obligations under these Terms and Conditions.
